‘This is a stick up': Mackay man's 'amateurish' robbery

MACKAY resident Patrick John Wallace Leggett made no attempt to hide his identity when he held up his local BWS on Bridge Rd in West Mackay.

Crown prosecutor Ron Swanwick told the District Court that on November 3 last year, about 1.30pm, Leggett took a 5L cask of wine to the counter and said "this is a stick up".

He said Leggett, 48, was recognised as a regular customer and was not taken seriously by the attendant, who ignored the comment.

Then Leggett said he wanted cigarettes and scotch and drew a steak knife from his pocket.

The attendant complied, and Leggett said "You can tell them my name is Patrick and I live at Napier St".

Later, Leggett returned to his residence in Napier St and joined by two friends, smoked and drank the stolen goods.

"During conversation, the defendant said 'I robbed a bottle shop'," said Mr Swanwick.

At 5.35pm that day, police conducted a search at Leggett's house and he was arrested.

"It may have been a fairly amateurish robbery, but even so, an armed robbery is still very serious for all concerned, and has the potential to become dangerous," said Mr Swanwick.

Defence barrister Bronwyn Hartigan told the court that Leggett suffered from schizophrenia and other health problems.

"The armed robbery has already been referred to as amateurish... but it goes further than that in that it was quite bizarre," she said.

"He didn't try to disguise himself in any way, shape or form."

Ms Hartigan said the explanation was Leggett's mental health condition, and the facts that he was drinking and not taking his medication.

Judge Brian Devereaux, SC, said it made Leggett "in one sense, less morally culpable," but there was a potential he could be dangerous. "Shops... are entitled to the protection of the law," he said.

Leggett pleaded guilty to charges of entering a premise with intent to commit an indictable offence and armed robbery.

He was sentenced to three years imprisonment, eligible for parole after nine months.
