Mine worker fined for behaviour near nightclub

A MINE worker with a history of problems with alcohol has been fined $1200 by a Mackay magistrate.

Blake Earl Wyborn, 23, of North Mackay, pleaded guilty to obstructing police in the vicinity of licensed premises and causing a public nuisance near licensed premises at 3.45am on Sunday, July 9.

Police prosecutor Senior Constable Duncan Erskine said police saw Wyborn, with no shirt on, near The Rabbit Hole, walk up to another man and hit him in the face.

Snr Const Erskine said the man who was hit did not know Wyborn, but did not want to make a complaint.

He said Wyborn then tried to walk away while he was under arrest, and slapped the hand of a police officer away, saying "get your f***ing hands off me".

Magistrate Scott Luxton told Wyborn: "You are very fortunate that an assault complaint was not made against you. Had an assault complaint been lodged and a plea of guilty or a finding of guilty with respect to the matter, you would find yourself in a serious circumstance.

"One only needs to look at recent media coverage that has been ongoing for some time as to the consequences when people behave as you did on this particular evening.

"I personally have dealt with numerous young people before the court who have effected an assault on another person and there have been dire consequences in terms of injury suffered."

"In your history there is a recurring theme of consumption of alcohol and untoward behaviour occurring."

Mr Luxton fined Wyborn $1200, and convictions were recorded.
