Judge could face restrictions after sibling rape comments

NSW District Court Judge Garry Neilson faces being banned from hearing sex cases after controversial comments he made about homosexuality, incest and paedophilia.

Judge Neilson made the comments during a case of a man, 58, facing trial for raping his younger sister in 1981 at the family's Sydney home.

Judge Neilson said a jury might find nothing untoward in the sexual advances of a brother to a sister who was sexually mature.

He went on to say juries regularly hear cases of sexual conduct which was once considered unnatural or taboo.

Judge Neilson's comments in 2014 caused a public outcry and politicians of all sides demanded action be taken against him.

The NSW Government filed a complaint with the Judicial Commission saying he had brought the court system into disrepute.

The commission, in handing down its findings this week, said Judge Neilson should not be referred to parliament for dismissal.

But it recommended NSW District Court Chief Judge Derek Price ban him from sitting on future sexual cases.
