'Despicable' man punched wife as she drove family car

THE behaviour of a man who punched his partner while she was driving with their child in the back was "despicable".

So too was another incident in which he had spat on the woman, Magistrate Graham Lee told the 25-year-old.

The man, who cannot be named due to domestic violence issues, was berating his de facto wife for the way she was driving his car on Anzac Ave on December 30, and punched her, Toowoomba Magistrates Court heard.

Police prosecutor Rowan Brewster-Webb said while the man had little care for his partner or their child in the back seat, he did care about his car, telling his wife at the time "Don't hurt my pride and joy".

Days later in what Mr Brewster-Webb described as "utterly shameful", the man had, during an argument, spat on his wife and punched her, causing her to clash heads with the child she was holding.

He appeared by video link from the prison to plead guilty to assault occasioning bodily harm and breaching a domestic violence order as well as to drug-driving while on a provisional licence on Bridge St on December 5, drug-driving while on a provisional licence on Platz St on December 18, and contravening a police protection order at Rangeville on January 22.

He had been subject to two separate three-month suspended jail terms at the time of the offences, Mr Brewster-Webb said.

Defence solicitor Brad Skuse said his client had served almost three months in pre-sentence custody and asked that he be released on parole.

His client was a hard worker when away from drug use but it was his drug problem that led to his offending, Mr Skuse submitted.

Magistrate Graham Lee described the man's actions as "very disturbing" and sentenced him to 12 months in jail but, declaring 115 days pre-sentence custody as time served, ordered he be released on parole immediately.

The man was disqualified from driving for more than three years.
