Moment of confusion as prison staff send wrong man to court

THERE was a moment of confusion in the courtroom, after the wrong person was transported from prison for sentencing.

Prosecution was this morning expecting a Samoan man named Felise Masei to appear in the dock to answer for drink driving charge.

Instead a middle-aged caucasian man named Charles Drinkwater had been brought in from the Brisbane Correctional Centre.

Defence lawyer Cameron Hodges said according to a pre sentence report, Mr Drinkwater went by the alias Felise Masei.

However according to the charge sheet, Mr Masei was Samoan and had a different date of birth to Mr Drinkwater.

Mr Hodges also noted that Mr Felise's alleged offence took place while Mr Drinkwater was in prison.

Magistrate Virginia Sturgess said it was clear the prison had brought in the wrong person.

"I do apologise for dragging you here today," she told Mr Drinkwater. "Unfortunately you'll have to go back to jail".

After failing to appear, a warrant was issued for Mr Masei's arrest.
